Phoebe:  My ASD child has been suspended 4 times in 6 weeks from his elementary school. He has an IEP and is an autism classroom. I have been told by another proffessional that the suspensions are basically them saying they cannot handle him in the classroom and the state is now liable to pay for a private school for him. I am new to this country and have no idea of my rights. please help.

  1. You could call an IEP meeting to discuss other interventions. It seems the behavior plan in place is not effective for your son. Seek help from the autism team at your school’s AEA.

  2. At this point, school actions are showing that they are not handling his behavior. However, the state education agency, hearing officers, & courts typically take the position that the school can & should develop an appropriate program for your child. Your state parent training & information center will know federal & state rules to assist you in dealing with this situation. http://www.parentcenterhub.org/find-your-center
