Services: IEP DECIDES PRIVATE PLACEMENT, PRIVATE SCHOOL REFUSES TO PROVIDE SERVICES FOR A YEAR

Jean Marie:  Parent referral to School District “A” early 8/16, IEP signed by late 8/16. Decision made to send child to private school in School District “B” early 9/16. School District “B” states child will not get services since referral was not made by their cut off date of June 2016. So any child who gets an IEP over the summer waits a full year to get services? Is this legal?  Thank you in advance!

  1. Is that legal? No. However, I would not use that language when trying to work things out with them. I would ask for an appointment with the person just above the person who put up the brick wall. I would give the administrator a half-page list of the problems your child is having and a half-page list of your top priority supports you think your child needs in order to receive FAPE. (Mention FAPE specifically.) Ask the administrator how you and the district can work together as a team to support your child’s success in school. Speak calmly and in an optimistic tone. If this administrator says nasty things, remain calm, leave, and try the next level up.
