IEP Termination: DISMISSED FROM IEP – PAYING OUT OF POCKET FOR SERVICES

Mary:  My child was dismissed from his IEP. He has significantly regressed in reading. We’ve been paying out of pocket for OT, Speech therapy and now were paying for a reading tutor to supplement what the school is not doing. The school is not taking into consideration that we’ve been supplementing services. Any advice would be appreciated.

  1. I have never heard the term “dismissed from and IEP”. Perhaps you mean that according to the school he did not qualify for an IEP? I hope that you did not agree and that they gave you a prior written notice to explain their reasons. This is required unless you signed that your child is out of the IEP. If so you can always request another testing to get your child back in. This will be difficult. If your child is regressing you should not have to pay for all of these services. The school should provide a FAPE. The next step is to get your child back on the IEP.

  2. I’d need to know more of the context. For example, diagnoses, grade or age, what evaluations have been done. Have you tried working with your local parent center?
