Kelli:  Can a para-professional be used to teach direct instruction of new content/topic in a SPED developmental preschool classroom with the certified SPED teacher present? My district received a grant for dual language, and because I do not speak Spanish, they are asking the paraprofessional to teach the entire 3 hour class twice per week. Is this legal?

  1. Depends on what is on the IEP. If you do not have it specifically stated that the tutoring is to be done by a tutor/teacher the school can do what they want. Sometimes the para can be better than a tutor so check out her credentials and you might be ok to stay with this person. If not request an IEP meeting and discuss getting the services you need.
