Tammy:  My child is 6 years old attends a private school. They evaluated her prior to school starting and determined she did not meet their kindergarten requirements. Started her in their preschool program. She has ADHD. We are trying to get her evaluation by the school district. According to IDEA she would not qualify for preschool special education. What can I do?

  1. I’m a little perturbed by the idea that a student “doesn’t qualify for kindergarten.” I mean… how?

  2. IDEA does not prohibit her from receiving preschool services. The IEP team must develop a plan with specially designed instruction to address her needs. While the team must consider LRE, they determine the placement.
