Laurie:  Can a general education teacher be excused from a 3 year evaluation and IEP, if the LEA and parent agree in writing for them to be excused?

  1. The reply did not answer this question in it’s entirety. You clarified that a regular education teacher can be excused from the IEP – but what about the 3 year re-evaluation? Can a reg. Ed. teacher be excused if the parent agrees in writing?

  2. A 3 year (triennial) evaluation and an IEP meeting have different purposes. The purpose of a triennial eval is to determine if the child continues to be eligible for special ed. The purpose of an IEP meeting is to develop the child’s IEP.

Attendance at an IEP meeting is not necessary if the parent and the school district agree that a member’s attendance is not necessary because the member’s area of the curriculum or related service will not be discussed or modified. (for other exceptions, please see page 135 in Wrightslaw: All About IEPs)
