Jen:  My son has PDD, ODD, and anxiety disorder. At home he is a typical 5 year old boy as well as when he is getting 1 on 1 attention. He has attended 2 years of ECSE in which the last year the teacher claims he had no behavioral or emotional issues and he could be mainstreamed into a normal classroom with no assistance. Jokes on Pre-k teacher as he is exhibiting plenty of behavioral issues and support in the classroom. Now the school wants to move him to a Emotional Impaired Classroom in another school district rather than providing him services at the home school which has MICI and ASD classrooms. We want him to stay at current school as he needs routine, consistency, familiarity as a major change will cause behavior issues. Should his school provide services like ABA, 1 on 1 aide in the classroom, or other services to help him rather than just pawning him off?

  1. yes you need to fight for this. Hopefully what is needed is clearly spelled out in the IEP so they have to provide the services you are asking for.

  2. Yes. The Individuals with Disabilities Education Act states that “In determining the educational placement of a child with a disability”… the placement decision –
    “(1) Is determined at least annually;
    (2) Is based on the child’s IEP; and
    (3) Is as close as possible to the child’s home;
    (c) Unless the IEP of a child with a disability requires some other arrangement, the child is educated in the school that he or she would attend if nondisabled;
    (d) In selecting the LRE, consideration is given to any potential harmful effect on the child or on the quality of services that he or she needs; and
    (e) A child with a disability is not removed from education in age-appropriate regular classrooms solely because of needed modifications in the general education curriculum. (Authority: 20 U. S. C. 1412(a) – see page 216 of Wrightslaw: Special Education Law
