Our county does not do 504 Plans. A person at school told me that the child study plan is like a 504 Plan.<\/p>\n<p>If the school writes a \u201cchild study plan,\u201d do they have to follow the strategies like in a IEP? If they do not follow the strategies, is the school in noncompliance with the plan? What can a parent<em> do?<br \/>\n<\/em><\/p><\/blockquote>\n<p>You say your district \u201cDoes not do 504\u2019s.\u201d <strong> <span style=\"font-weight: normal;\"><a href=\"https:\/\/www.wrightslaw.com\/info\/sec504.index.htm\"><span style=\"color: #000080;\">Section 504 of the Rehabilitation Act<\/span><\/a> is a federal civil rights law that prohibits discrimination against individuals with disabilities. <strong>Compliance is not optional.<\/strong> <\/span><\/strong><\/p>\n<p><strong><span style=\"font-weight: normal;\">Under Section 504, the child with a disability has equal access to an education. A 504 Plan may include accommodations and modifications. <\/span><\/strong><\/p>\n<p><strong><span style=\"font-weight: normal;\">A Section 504 Plan is <\/span><span style=\"text-decoration: underline;\">not<\/span><span style=\"font-weight: normal;\"> the same as a Child Study Plan<\/span><span style=\"font-weight: normal;\">.<\/span><\/strong><\/p>\n<p>You need to &#8230;<!--more--><\/p>\n<p><strong>write a short, factual letter to the director of special ed or school supervisor<\/strong>. Explain that you were told that your district &#8220;doesn&#8217;t do 504&#8217;s&#8221; and that [someone] advised you that a Child Study Plan is like a 504 Plan. You are confused &#8211; this is not consistent with what you&#8217;ve read elsewhere. Ask if your understanding is correct.<\/p>\n<p>In Virginia, a Child Study Team is part of the <a href=\"https:\/\/www.wrightslaw.com\/info\/child.find.index.htm\"><span style=\"color: #000080;\">Identification and Referral<\/span><\/a> process. These teams have different names in other states and may operate differently. The Team recommends strategies to address a child\u2019s learning, behavior, communication, or development problems. The Child Study Team may also refer the child for a special education evaluation.<\/p>\n<p><span style=\"color: #000080;\"><strong>Get Your State Special Ed Regulations<\/strong><\/span><\/p>\n<p>You need to learn how to find and use your state special education regulations. You need to learn about school teams, child study teams, child find, identification &amp; referral in your state.<\/p>\n<p>Go to the <a href=\"http:\/\/www.yellowpagesforkids.com\/\"><span style=\"color: #000080;\">Wrightslaw Yellow Pages for Kids site<\/span><\/a> and click the link to the <a href=\"http:\/\/www.yellowpagesforkids.com\/help\/seas.htm\"><span style=\"color: #000080;\">Directory of <\/span><\/a><span style=\"color: #000080;\"><a href=\"http:\/\/www.yellowpagesforkids.com\/help\/seas.htm\"><span style=\"color: #000080;\">State Departments of Education<\/span><\/a><a href=\"http:\/\/www.yellowpagesforkids.com\/help\/seas.htm\">.<\/a><\/span> You should be able to download your state special ed regulations from your State Dept of Education&#8217;s web site. Save the regulation on your computer.<\/p>\n<p>To find information about a topic like &#8220;child study,&#8221; search the your state regulations. Type Control-F (Find) then type \u201cchild study.\u201d The information you locate will get you up and running.<\/p>\n<p><strong><span style=\"color: #000080;\">Section 504 Prohibits Discrimination<\/span><\/strong><\/p>\n<p><strong>Remember:<\/strong> <a href=\"https:\/\/www.wrightslaw.com\/info\/sec504.index.htm\"><span style=\"color: #000080;\">Section 504 of the Rehabilitation Act<\/span><\/a> is a federal statute that prohibits discrimination against individuals with disabilities. The person who said your district &#8220;doesn&#8217;t do 504 Plans&#8221; is misinformed.
