The child care providers failed to reasonably modify their programs to accommodate the needs of young children with Type 1 diabetes and \u201cdis-enrolled\u201d the children because of their disabilities, violating the ADA.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-25583 alignright\" src=\"https:\/\/www.wrightslaw.com\/blog\/wp-content\/uploads\/2020\/02\/girl.diabetes.bear_.jpg\" alt=\"\" width=\"339\" height=\"239\" srcset=\"https:\/\/www.wrightslaw.com\/blog\/wp-content\/uploads\/2020\/02\/girl.diabetes.bear_.jpg 363w, https:\/\/www.wrightslaw.com\/blog\/wp-content\/uploads\/2020\/02\/girl.diabetes.bear_-300x212.jpg 300w\" sizes=\"auto, (max-width: 339px) 100vw, 339px\" \/><\/p>\n<p>One agreement is with Lil\u2019 Einstein\u2019s Learning Academy (LELA) which operates two child care facilities in Delaware and two in Maryland. The second agreement is with the Community First School Corp. (CFS), which operates a child care facility in Sunnyvale, California.<\/p>\n<p><strong>Terms of the Settlement Agreements<\/strong><\/p>\n<p>Under the agreements, LELA agreed to pay $25,000 in compensatory damages to the child and her parents and $2,500 in civil penalties. CFS agreed to pay $15,000 to the child and her parents and $2,500 in civil penalties.<\/p>\n<p>In addition, the child care centers agreed to evaluate each request for reasonable modifications on an individualized basis, using objective evidence and current medical standards. They also agreed to to train staff members to help with routine diabetes care \u2014 monitoring a continuous glucose monitor, administering Glucagon in emergency situations, and administering insulin by pen, syringe, or pump.<\/p>\n<p><a href=\"https:\/\/www.ada.gov\/lil_einstein_sa.html\">Settlement Agreement Between The United States of America and Lil\u2019 Einstein\u2019s Learning Academy (DJ No. 202-15-82)<\/a><\/p>\n<p><a href=\"https:\/\/www.ada.gov\/community_first_school_sa.html\">Settlement Agreement Between The United States of America and Community First School Corp.
