These cases are \u201cmust reads\u201d for special education attorneys, advocates, and others who are interested in special education law.<\/p>\n<p><strong>2018 Wrightslaw Case of the Year, <\/strong><a href=\"https:\/\/www.wrightslaw.com\/law\/art\/analysis.6th.lh.hamilton.htm\"><span style=\"color: #0066cc;\"><em>L.H. v. Hamilton County<\/em><strong>,<\/strong><\/span><\/a> is a powerful Mainstreaming\/Inclusion case that attorneys will rely upon for many years.<\/p>\n<p>In this case, the <strong>parents prevailed<\/strong> in this Sixth Circuit decision about mainstreaming\/inclusion, LRE, FAPE, parental rights, and tuition reimbursement.<\/p>\n<p><span style=\"color: #000080;\"><strong>Meet Luke<\/strong><\/span><\/p>\n<p>Luke (L.H.) is a child with Down Syndrome. He is a sociable, likeable child. Yet school staff had low expectations for Luke, segregated him in the back of class before they placed him, over his parents\u2019 clearly expressed objections, in a self-contained classroom in another school.<\/p>\n<p>The Court held that the school violated the procedural requirement of IDEA, was unable to design an IEP to meet Luke\u2019s needs, and therefore denied FAPE.<\/p>\n<p><span style=\"color: #000080;\"><strong>Sixth Circuit Decision<\/strong><\/span><\/p>\n<p>Judge Batchelder&#8217;s opinion was passionate. The decision had much to say about the obliviousness of school staff who refused to develop an IEP that included Luke because they didn\u2019t believe mainstreaming could work.<\/p>\n<p style=\"padding-left: 40px;\"><em>We conclude that the educational program at TMS satisfied the IDEA and, therefore, LH\u2019s parents were entitled to reimbursement. The district court erred in holding otherwise.<\/em><\/p>\n<p>The <a href=\"https:\/\/www.wrightslaw.com\/law\/caselaw\/2018\/6th.tn.lh.hamilton.lre.pdf\"><span style=\"color: #0066cc;\">6th Circuit decision<\/span><\/a> in <em>L.H. v. Hamilton<\/em> describes the school district&#8217;s arguments as worrisome and bizarre and others as disingenuous and without merit.<\/p>\n<p>The Court found that &#8211;<\/p>\n<p style=\"padding-left: 40px;\"><em>This is really an argument against \u2018mainstreaming\u2019 as a concept, because [the district] believes it is impossible, impracticable, or counterproductive.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em>&#8230;if it is truly [the district&#8217;s] view, then it is worrisome and inadvertently supports &#8230; that the teachers and staff reject mainstreaming because they don\u2019t understand it, don\u2019t believe in it, and need training on why it is valuable and how to do it.<\/em><\/p>\n<p>In <em><strong>Wrightslaw: Special Education Legal Developments &amp; Cases 2018<\/strong><\/em>, you will learn how much the court ordered the school district to pay.<\/p>\n<p>Read the Analysis of<a href=\"https:\/\/www.wrightslaw.com\/law\/art\/analysis.6th.lh.hamilton.htm\"><span style=\"color: #0066cc;\"> <em>L.H. v.
