This form would put her in charge of her IEP meetings.<\/p>\n<p>Do we have to allow this? My daughter is not able to handle that on her own.<\/p><\/blockquote>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-23626\" src=\"https:\/\/www.wrightslaw.com\/blog\/wp-content\/uploads\/2018\/12\/girl.glasses.tired_.work_.jpg\" alt=\"\" width=\"461\" height=\"310\"\/><\/p>\n<p><span style=\"color: #000080;\"><strong>Age of Majority<\/strong><\/span><\/p>\n<p>IDEA 2004, the federal special education law, has a section about educational decision-making when the child reaches the <em>age of majority<\/em> under state law &#8211; this is usually age 18.<\/p>\n<p><strong>The school district must provide notice to the parent and child<\/strong> that the parents\u2019 rights will transfer to the child when the child reaches the <em>age of majority.<\/em><\/p>\n<p>This is why you received the form.<\/p>\n<p><a href=\"https:\/\/www.wrightslaw.com\/store\/selaw2.store.html\"><span style=\"color: #0066cc;\"><em><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-13179 alignleft\" src=\"https:\/\/www.wrightslaw.com\/blog\/wp-content\/uploads\/2015\/09\/selaw2.100.dpi500.jpg\" alt=\"\" width=\"148\" height=\"191\"\/>Wrightslaw: Special Education Law, 2nd Edition<\/em><\/span><\/a>.<\/p>\n<p>See what IDEA says about the &#8211; Transfer of Parental Rights at Age of Majority<br \/>\n20 U.S.C. Section1415(m)(1) and (2) on page 123<\/p>\n<p>In the federal regulations at<br \/>\n34 CFR 300.520(a) and (b) on page 263<\/p>\n<p>You can consult an attorney and request that he or she draw up a Power of Attorney so you can continue to represent your child\u2019s educational interests.<\/p>\n<p>Or, you can have your child write a statement that says:<\/p>\n<p style=\"padding-left: 30px;\"><em>I [child\u2019s name], pursuant to 20 U.S.C. Section 1415(m) and [your state\u2019s special education regulation], hereby appoint my parent, [your name} to represent my educational interests.<\/em><\/p>\n<p>If your child is able, have her write this statement out in longhand, sign, and date it.<\/p>\n<p>If you need help with this, I recommend you contact your state\u2019s <a href=\"http:\/\/www.yellowpagesforkids.com\/help\/ptis.htm\"><span style=\"color: #0066cc;\">Parent Information &amp; Training Center<\/span><\/a>.
