Section 1401(30)<\/p>\n<p>(30) Specific Learning Disability.<\/p>\n<p>(A) In General. The term \u2018specific learning disability\u2019 means a disorder in 1 or more of the basic psychological processes involved in understanding or in using language, spoken or written, which disorder may manifest itself in the imperfect ability to listen, think, speak, read, write, spell or do mathematical calculations.<\/p>\n<p>(B) Disorders Included. Such term includes such conditions as perceptual disabilities, brain injury, minimal brain dysfunction, dyslexia, and developmental aphasia.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-13179\" style=\"margin-left: 10px;\" src=\"https:\/\/www.wrightslaw.com\/blog\/wp-content\/uploads\/2015\/09\/selaw2.100.dpi500.jpg\" alt=\"\" width=\"106\" height=\"135\" \/>You will find this definition on page 55 in your Law book.<\/p>\n<p><a href=\"https:\/\/www.wrightslaw.com\/store\/selaw2.store.html\"><em><span style=\"color: #0066cc;\">Wrightslaw: Special Education Law, 2nd Edition<\/span><\/em><\/a><\/p>\n<p>Dyslexia is a language learning disability in reading, writing, spelling and\/or math. From a legal perspective, dyslexia is a learning disability that adversely affects educational performance.<\/p>\n<ul>\n<li style=\"padding-left: 5px;\"><span style=\"color: #000000;\"><em>Dyslexia is just a general term and doesn\u2019t really mean anything, so we don\u2019t have to provide services to kids with dyslexia.<\/em><\/span><\/li>\n<\/ul>\n<p>Do not argue with the school. You will not change their attitudes and beliefs.<\/p>\n<p>Shift the discussion and focus on using the <a href=\"https:\/\/www.wrightslaw.com\/blog\/learn-how-to-ask-the-5-ws-h-e-questions\/\"><span style=\"color: #0066cc;\">5 Ws + H + E<\/span> <\/a>questions. Ask questions to flush out their positions so that you can figure out how to change their focus.<\/p>\n<p>A straight up argument is not persuasive and does not change their perspective. However, their own emotional response is impacted by empathy. Market to those emotions to change their thinking and perspective.<\/p>\n<ul>\n<li style=\"padding-left: 5px;\"><span style=\"color: #000000;\"><em>Your child is just developing slower than most children, so we don\u2019t want to provide any help with reading until third grade.<\/em><\/span><\/li>\n<\/ul>\n<p>Learn about the principles of early intervention and the importance of learning how to read up to third grade. After third grade, children are reading to learn.<\/p>\n<p>Try to help the school team see the damage created by waiting to fail &#8211; rather than focus on intervention now. Emphasize the importance of avoiding the damaging effects of failure.<\/p>\n<p>When children cannot read, they fall further behind and do not catch up.<\/p>\n<ul>\n<li style=\"padding-left: 5px;\"><span style=\"color: #000000;\"><em>Your child is doing OK, he is not that far behind. Even though you don\u2019t see it, we believe he is making progress.<\/em><\/span><\/li>\n<\/ul>\n<p>Use the bell curve and make a power point percentile rank bar graph. (<a href=\"https:\/\/www.wrightslaw.com\/store\/cd.test.scores.html\"><span style=\"color: #0066cc;\">Instructions are here<\/span><\/a>.)<\/p>\n<p>Compare your child\u2019s educational achievement test scores in reading, writing, arithmetic and spelling &#8211; on the same test, over time.<\/p>\n<p>If your child really is <a href=\"https:\/\/www.wrightslaw.com\/advoc\/articles\/tests_measurements.html\"><span style=\"color: #0066cc;\">making progress, that will be evident from the test data<\/span><\/a>. If not, you will know that he is <strong>not<\/strong> making progress, and the bar graph with show this.<\/p>\n<p>To determine true progress (or not) data must be objective and independent.
