The team would not be discussing our draft, or our concerns.<\/p>\n<p>Is this legal?<\/p><\/blockquote>\n<p>It would be interesting to see the rule, regulation, statute, or local policy that restricts the Present Levels to input from the school only &#8211; or \u201conly the school\u2019s perspective.\u201d<\/p>\n<p>Politely tell the school you\u2019re confused about this, and ask (in writing) for a written copy of the policy to clarify.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-21156\" style=\"border: 1px solid #000000;\" src=\"https:\/\/www.wrightslaw.com\/blog\/wp-content\/uploads\/2017\/02\/parent.expert.mtg_.jpg\" alt=\"Parents talk with psychologist about recent psycho-educational evaluation\" width=\"500\" height=\"334\" srcset=\"https:\/\/www.wrightslaw.com\/blog\/wp-content\/uploads\/2017\/02\/parent.expert.mtg_.jpg 450w, https:\/\/www.wrightslaw.com\/blog\/wp-content\/uploads\/2017\/02\/parent.expert.mtg_-300x200.jpg 300w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/p>\n<p><em>There is nothing in the federal statute or regulations that says the law does not allow parent input<\/em>. But don\u2019t depend on this post \u2013 learn for yourself what the law says.<\/p>\n<p>Check your <a href=\"https:\/\/www.wrightslaw.com\/bks\/selaw2\/selaw2.htm\"><span style=\"color: #0066cc;\"><em>Wrightslaw: Special Education Law<\/em> book<\/span><\/a>, p. 99 &amp; 245.<br \/>\n20 U.S.C. 1414(d) and 34 CFR 300.320.<\/p>\n<p>The IEP (that includes the written statement of Present Levels) is developed, reviewed, revised\u2026 in a meeting in accordance with sections 34 CFR 300.320 through 300.324.<\/p>\n<p>These sections speak to the make-up of the IEP Team, <strong>that includes (listed first), the parent of the child<\/strong>, and <strong>parent participation<\/strong> in the IEP.<\/p>\n<p>Some states actually have a place in the Present Levels section for parent input.<\/p>\n<p>For example, see the <a href=\"https:\/\/www.pattan.net\/getattachment\/Forms\/INDIVIDUALIZED-EDUCATION-PROGRAM-IEP-ANNOTATED\/Annotated-IEP\/Annotated-IEP-2018-(1).pdf?lang=en-US&amp;ext=.pdf\"><span style=\"color: #0066cc;\">PA annotated IEP form (2018)<\/span><\/a> page 13, 14 for the Present Levels section that asks for \u201cParental concerns for enhancing the education of the student.\u201d<\/p>\n<p><a href=\"https:\/\/www.pattan.net\/getattachment\/Forms\/INDIVIDUALIZED-EDUCATION-PROGRAM-IEP-ANNOTATED\/Annotated-IEP\/Annotated-IEP-2018-(1).pdf?lang=en-US&amp;ext=.pdf\"><span style=\"color: #0066cc;\">https:\/\/www.pattan.net\/getattachment\/Forms\/INDIVIDUALIZED-EDUCATION-PROGRAM-IEP-ANNOTATED\/Annotated-IEP\/Annotated-IEP-2018-(1).pdf?lang=en-US&amp;ext=.pdf<\/span><\/a><\/p>\n<p>Read what IDEA says about the development of the IEP.
