U.S. Dept of Education<\/em> featured as a Case of the Year in <a href=\"https:\/\/www.wrightslaw.com\/bks\/2018law\/index.htm\"><em><span style=\"color: #0066cc;\">Wrightslaw: Special Education Legal Developments &amp; Cases 2018<\/span><\/em><\/a>, pages 42 and 124.<\/p>\n<p>USDOE withheld $33.3 million from Texas when the TEA failed to comply with IDEA requirements for state financial support for special ed. Texas appealed to the Fifth Circuit which denied the petition for review and upheld the USDOE.<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;<\/p>\n<p><a href=\"https:\/\/www.nytimes.com\/2018\/01\/11\/us\/texas-special-education.html\"><span style=\"color: #0066cc;\">Texas Illegally Excluded Thousands From Special Education, Federal Officials Say<\/span><\/a><\/p>\n<p><a href=\"https:\/\/www.nytimes.com\/2018\/01\/11\/us\/texas-special-education.html\"><span style=\"color: #0066cc;\">\u00a0https:\/\/www.nytimes.com\/2018\/01\/11\/us\/texas-special-education.html<\/span><\/a><\/p>\n<p>&#8220;Federal regulators said Thursday that Texas\u2019s decision to set a \u201ctarget\u201d for the maximum percentage of students who should receive special education services violated federal laws.&#8221;<\/p>\n<p>&#8220;In the <a href=\"https:\/\/www2.ed.gov\/fund\/data\/report\/idea\/partbdmsrpts\/dms-tx-b-2017-letter.pdf\"><span style=\"color: #0066cc;\">letter, federal regulators ordered the state<\/span><\/a> to design a plan to identify students who were inappropriately kept out of special education and to figure out how to help them, among other corrective actions.&#8221;<\/p>\n<p><a href=\"https:\/\/www2.ed.gov\/fund\/data\/report\/idea\/partbdmsrpts\/dms-tx-b-2017-letter.pdf\"><span style=\"color: #0066cc;\">https:\/\/www2.ed.gov\/fund\/data\/report\/idea\/partbdmsrpts\/dms-tx-b-2017-letter.pdf<\/span><\/a><\/p>\n<p>&#8220;The order brought to an end one of the <a href=\"https:\/\/www2.ed.gov\/fund\/data\/report\/idea\/partbdmsrpts\/dms-tx-b-2017-enclosure.pdf\"><span style=\"color: #0066cc;\">Department of Education\u2019s most extensive reviews<\/span><\/a> in recent history.
