padding-top:10px;\" class=\"hupso-share-buttons\"><!-- Hupso Share Buttons - https:\/\/www.hupso.com\/share\/ --><a class=\"hupso_pop\" href=\"https:\/\/www.hupso.com\/share\/\"><img decoding=\"async\" src=\"https:\/\/static.hupso.com\/share\/buttons\/gallery\/share-button-gray.png\" style=\"border:0px\" alt=\"Share\" \/><\/a><script type=\"text\/javascript\">var hupso_services=new Array(\"Twitter\",\"Facebook\",\"Google Plus\",\"Pinterest\",\"Linkedin\",\"StumbleUpon\",\"Digg\",\"Reddit\",\"Bebo\",\"Delicious\");var hupso_icon_type = \"labels\";var hupso_background=\"#FFFFFF\";var hupso_border=\"#FFFFFF\";var hupso_image_folder_url = \"\";var hupso_twitter_via=\"wrightslaw\";var hupso_url=\"\";var hupso_title=\"Students%20with%20Disabilities%20Face%20Harsher%20Discipline\";<\/script><script type=\"text\/javascript\" src=\"https:\/\/static.hupso.com\/share\/js\/share.js\"><\/script><!-- Hupso Share Buttons --><\/div><p><strong>&#8220;Feds investigate claims that black and disabled students face harsher discipline in Richmond&#8221;<\/strong><!--more--><\/p>\n<ul>\n<li>exclusionary and disproportionate discipline practices<\/li>\n<li>discipline that is unfair and inconsistent<\/li>\n<li>failure to implement positive behavior interventions<\/li>\n<li>evaluating a student for \u201cpunishment,\u201d\u00a0 without considering his disabilities<\/li>\n<li>suspension for minor offenses, no other alternatives available<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.wrightslaw.com\/blog\/wp-content\/uploads\/2017\/04\/disc.beh_.anxious.teen_.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-21755\" src=\"https:\/\/www.wrightslaw.com\/blog\/wp-content\/uploads\/2017\/04\/disc.beh_.anxious.teen_.jpg\" alt=\"\" width=\"519\" height=\"344\" \/><\/a><\/p>\n<p>&#8220;The U.S. Education Department will investigate allegations of discrimination against African American students and students with disabilities in Richmond [VA] public schools.&#8221;<\/p>\n<p>&#8220;The investigation by the department\u2019s Office of Civil Rights follows a <a href=\"http:\/\/apps.washingtonpost.com\/g\/documents\/local\/civil-rights-complaint-filed-against-richmond-public-schools-alleges-discrimination-in-discipline\/2134\/\"><span style=\"color: #0066cc;\">complaint<\/span><\/a> filed in August on behalf of two students and the Richmond chapter of the NAACP, by the\u00a0Legal Aid Justice Center and the ACLU of Virginia.&#8221;<\/p>\n<p>&#8220;The complaint alleged that the school system\u2019s discipline policies unfairly punish students who are black and students with disabilities more harshly than others.&#8221;<\/p>\n<p>&#8220;It cited state statistics that black students with disabilities were nearly 13 times as likely as non-disabled white students to be punished with short-term suspensions in the 2014-2015 school year.&#8221;<\/p>\n<p>&#8220;The complaint also alleges that although students with disabilities made up 17.7 percent of the student population, they accounted for 29.8 percent of students who were suspended short-term and 37.4 percent of students who were suspended long-term.&#8221;<\/p>\n<p>&#8220;Rachael Deane of the Legal Aid Justice Center said the complaint had been filed before the start of this school year, and<em><strong> unfortunately we have continued to see the same overuse of exclusionary discipline.<\/strong>\u00a0Clients continue to stream into our office<\/em>.&#8221;<\/p>\n<p>OCR opened an investigation but has not yet made a determination on the merits of the allegations.<\/p>\n<p>&#8211;
