{"id":2094,"date":"2010-01-18T10:19:29","date_gmt":"2010-01-18T14:19:29","guid":{"rendered":"http:\/\/www.wrightslaw.com\/blog\/?p=2094"},"modified":"2010-01-18T10:22:50","modified_gmt":"2010-01-18T14:22:50","slug":"its-all-about-buildings-not-education","status":"publish","type":"post","link":"https:\/\/www.wrightslaw.com\/blog\/its-all-about-buildings-not-education\/","title":{"rendered":"It&#8217;s all about Buildings &#8211; not Education!"},"content":{"rendered":"<div style=\"padding-bottom:20px; padding-top:10px;\" class=\"hupso-share-buttons\"><!-- Hupso Share Buttons - https:\/\/www.hupso.com\/share\/ --><a class=\"hupso_pop\" href=\"https:\/\/www.hupso.com\/share\/\"><img decoding=\"async\" src=\"https:\/\/static.hupso.com\/share\/buttons\/gallery\/share-button-gray.png\" style=\"border:0px\" alt=\"Share\" \/><\/a><script type=\"text\/javascript\">var hupso_services=new Array(\"Twitter\",\"Facebook\",\"Google Plus\",\"Pinterest\",\"Linkedin\",\"StumbleUpon\",\"Digg\",\"Reddit\",\"Bebo\",\"Delicious\");var hupso_icon_type = \"labels\";var hupso_background=\"#FFFFFF\";var hupso_border=\"#FFFFFF\";var hupso_image_folder_url = \"\";var hupso_twitter_via=\"wrightslaw\";var hupso_url=\"\";var hupso_title=\"It%27s%20all%20about%20Buildings%20-%20not%20Education%21\";<\/script><script type=\"text\/javascript\" src=\"https:\/\/static.hupso.com\/share\/js\/share.js\"><\/script><!-- Hupso Share Buttons --><\/div><blockquote><p><img loading=\"lazy\" decoding=\"async\" class=\"alignright\" style=\"border: 1px solid black; margin: 5px;float:right\" src=\"https:\/\/www.wrightslaw.com\/nltr\/img\/school\/school.ramp.jpg\" alt=\"\" width=\"131\" height=\"150\" \/>The Board of Directors of our public schools is being urged to adopt a plan that would segregate all elementary school children with physical disabilities into one of the district&#8217;s five elementary schools.\u00a0Is this illegal?<\/p>\n<p>The board member proposing this said &#8220;It&#8217;s not about education.\u00a0 It&#8217;s about buildings.&#8221;\u00a0 He promotes neighborhood schools close to home for non-disabled children, while forcing all children with disabilities into one school.<\/p><\/blockquote>\n<p>That&#8217;s crazy and, yes, it is illegal.<!--more--><\/p>\n<p>The law requires schools to educate children with disabilities, including physical disabilities, in regular education classes with children who are not disabled \u201cto the maximum extent possible.&#8221; A child may not be removed from regular education classes unless the nature or severity of the disability does not allow her to be educated in regular classes, even with supplementary aids and services.\u00a0 20 U.S.C. \u00a7 1412(a)(5); 34 C.F.R \u00a7 300.314 &#8211; 300.317.<\/p>\n<p>A child\u2019s <strong>placement must be<\/strong>:<br \/>\n\u2022 Based on the child\u2019s unique needs as documented in the IEP<br \/>\n\u2022 Determined at least once a year<br \/>\n\u2022 As close to the child\u2019s home as possible so the child can be educated in the school he would attend if he was not disabled<\/p>\n<p>A child\u2019s <strong>placement may not be based on<\/strong>:<br \/>\n\u2022 Your child\u2019s disability category or label or severity of the disability (i.e., children with autism are placed in a class with other children with autism)<br \/>\n\u2022 The school\u2019s service delivery model (i.e., all children with learning disabilities receive \u201cpull\u201d or resource services)<br \/>\n\u2022 The availability of special education and related services, staff location, or school district convenience. <a href=\"https:\/\/www.wrightslaw.com\/idea\/comment\/46579-46629.reg.101-230.esy.lre.etc.pdf\"><span style=\"color: #000080;\">Commentary<\/span><\/a> in 71 Federal Register at 46588.<\/p>\n<p>The School Board member proposing this needs to learn what the law says about educating children in the least restrictive environment. This has been the law since 1975.<\/p>\n<p><strong>Collaboration Counts<\/strong><\/p>\n<p>You need to get a little group of concerned people together.
