Barnstable\" href=\"https:\/\/www.wrightslaw.com\/law\/art\/fitzgerald.barnstable.supct.htm\"><span style=\"color: #000080;\"><span style=\"color: #0066cc;\">Fitzgerald v. Barnstable Sch. Committee<\/span><\/span><\/a>, 555 U. S. ___ (2009). <\/em>This decision on behalf of a young child who was sexually harassed by an older student <span style=\"color: #000080;\"><span style=\"color: #000000;\">clarified that parents may sue school officials under discrimination laws.<\/span><\/span><\/p>\n<p><strong><span style=\"color: #000080;\"><em>Forest Grove School District v. T. A<\/em>.<\/span><em><span style=\"color: #000080;\">,<\/span><\/em><span style=\"color: #000080;\"> 08-305<\/span><\/strong><em><span style=\"color: #000080;\"><br \/>\n<\/span><\/em><a href=\"https:\/\/www.wrightslaw.com\/law\/caselaw\/08\/9th.forest.grove.ta.htm\"><span style=\"color: #000080;\"><span style=\"color: #0066cc;\">https:\/\/www.wrightslaw.com\/law\/caselaw\/08\/9th.forest.grove.ta.htm<\/span><\/span><\/a><\/p>\n<p><a title=\"Forest Grove School District v. T. A. \" href=\"https:\/\/www.wrightslaw.com\/law\/caselaw\/08\/9th.forest.grove.ta.htm\"><span style=\"color: #0066cc;\"><em>Forest Grove School District v. T. A<\/em>.<\/span><\/a> is a case about tuition reimbursement for a child with ADHD, learning disabilities and depression. Despite these ongoing problems, the school district did not find him eligible for special education &#8212; so he did not receive special education services. <span style=\"color: #0066cc;\"><a style=\"color: #0066cc;\" title=\"Forest Grove Sch. Dist. v. T.A., 08-305\" href=\"https:\/\/www.wrightslaw.com\/nltr\/09\/nl.0204.htm#2\">More<\/a>.<\/span><\/p>\n<p>The question presented in <span style=\"color: #0066cc;\"><em><a style=\"color: #0066cc;\" title=\"Forest Grove School District v. T. A. \" href=\"https:\/\/www.wrightslaw.com\/law\/caselaw\/08\/9th.forest.grove.ta.htm\"><em>Forest Grove v. T.A. <\/em><\/a><\/em><\/span>is whether parents who unilaterally enroll their disabled child in a private school are entitled to tuition reimbursement <em>if the child never received special education from the district<\/em>.<\/p>\n<p>Oral argument in <em>Forest Grove School District v. T. A.<\/em> is scheduled for<strong> Tuesday, April 28, 2009<\/strong>.<\/p>\n<p><strong><span style=\"color: #800000;\">Wrightslaw Update:<\/span><\/strong> U.S. Supreme Court remanded the case back to U.S. District Court, school prevailed, parents appealed again to Ninth Circuit, school prevailed.<\/p>\n<p>The parents appealed to the Court of Appeals for the 9th Circuit. On April 27, 2011, in <a href=\"https:\/\/www.wrightslaw.com\/law\/caselaw\/11\/9th.forest.grove.ta-2.pdf\"><span style=\"color: #0066cc;\">a split decision<\/span><\/a>, the 9th Circuit upheld the District Court&#8217;s ruling. In a strong dissent, Judge Susan Graber faulted the majority on several grounds. Quoting directly from the 9th Circuit&#8217;s original decision, she noted that it was undisputed that T.A.&#8217;s parents placed him in the private program for reasons related to and unrelated to his disabilities. The District Court&#8217;s decision was not supported by the record.<\/p>\n<p><strong>What next?<\/strong> We don&#8217;t know. Redding<\/em> (08-479)<br \/>\n<\/span><\/strong><a href=\"https:\/\/www.wrightslaw.com\/blogs\/09\/safford.redding.htm\"><span style=\"color: #000080;\"><span style=\"color: #0066cc;\">https:\/\/www.wrightslaw.com\/blogs\/09\/safford.redding.htm<\/span><\/span><\/a><\/p>\n<p>In 2003, school officials in the Safford School District (AZ) strip-searched a 13-year-old girl on the basis of an uncorroborated &#8220;tip.&#8221; Another student claimed Savana had &#8220;prescription strength&#8221; ibuprofen on her person. Savana was an honor student who had no prior history of drug use or discipline problems. No drugs were found.<\/p>\n<p>Oral argument in <a href=\"https:\/\/www.wrightslaw.com\/blogs\/09\/safford.redding.htm\"><span style=\"color: #000080;\"><em><span style=\"color: #0066cc;\">Safford v. Redding<\/span><\/em><\/span><\/a> is scheduled for <strong>Tuesday, April 21, 2009<\/strong>.<\/p>\n<p>The questions presented are:<\/p>\n<p>1. Whether the Fourth Amendment prohibits public school officials from conducting a search of a student suspected of possessing and distributing a prescription drug on campus in violation of school policy.<\/p>\n<p>2.
