Lost at due process and review. Issue about need for child to enroll prior to preparation of IEP.


OR - Settlegoode v. Portland
Complaint by William Goode
.

Pamella Settlegoode, a special education teacher was retaliated against and fired for advocating for her students.

After she was fired, Dr. Settlegoode filed suit against her school district and supervisors. On November 16, 2001, a jury found for Dr. Settlegoode on all claims. The jury awarded her one million dollars and an additional $50,000 in punitive damages against the special education director and an assistant.

OH - Burriola v. Toledo

Complaint by Thomas Zraik.

Jordan Burriola, a young child with autism, was abruptly terminated from his day care center. In Jordan Burriola v. Greater Toledo YMCA,the Court issued an injunction against the YMCA. The YMCA was ordered to reinstate Jordan and train staff to work with him.

NV - Witte v. Clark County
Complaint by Sara Winter, Clark County Legal Services Program, Inc.

Shawn Witte was placed in the Variety School, a public school that provides special education services for disabled children. Shawn was physically and emotionally abused and tormented by his teacher and other school staff.

AR - Fales v. Garst
Complaint by Marcia Barnes. Mitchell, Blackstock, Barnes, Wagoner, and Ivers.

Lawsuit filed by three special education teachers against the principal of their school.

VA - Jaynes v. Newport News
Complaint by Pete Wright.

A discussion of statutes of limitations, procedural safeguards, notice requirements, damages and reimbursement.

CO - McArthur v. Academy
Complaint by Jeffrey Weeks. Weeks and Luchetta, LLP.

Parents Sue After Daughter Assaulted by "Peer Tutor".

VA - White v. Virigina
Complaint by Pete Wright.

AK - Noon v. Alaska
Complaint by David Fleurant Disability Law Center of Alaska.

To allow all students with disabilities in the class of 2004 to graduate whether or not they have passed the high school exit exam.

GA - Draper v. Atlanta
Complaint by David Monde, Jones Day. Wyner and Tiffaney.

U. S. District Court Judge found that the school system misdiagnosed a child with dyslexia as mentally retarded, refused to evaluate him, failed to reevaluate him as required by law, failed to provide him with a free appropriate education.

Judge ordered school to pay for four years of compensatory education at a private special education school.
