Patti:  My son was given an IEP (for ASD and ADHD) by the public school system, but the following year we placed him in a private school that specializes in children on the Autism Spectrum. Is the public school district obligated to provide transportation to and from the private school under the Education for Handicapped Children Act of 1975?

  1. Yes, Public school is responsible in providing transportation under the federal law.
If private placement was agreed upon due to public school not able to meet his needs,
then yes, they must provide transportation.

  2. Patti – Did you have any luck finding an answer to this? I am having a similar problem and can’t seem to get a straight answer to save my soul! I don’t know where to turn!
