Bullying: RIGHTS OF STUDENTS IN GENERAL ED VS. SPECIAL ED

CMD:  what are the rights of a 3rd grade girl who is being bullied by a special education boy. He ask girls to unzip their coats so he can see their shirts, if they don’t do it he hits this little girl. He won’t let her use a red crayon without hitting her. If he gets mad or has a melt down, he comes back to class and goes to her cubbie and throws her things a round. If some turns a way he doesn’t like he hits her. She is terrified. Why does his rights allow him to hurt her all school year?

  1. The boy’s behavior is not okay, and it sounds like he isn’t getting the services that he requires or that he isn’t in his least restrictive environment. I encourage you to focus on how the school handles the problems, not on the boy. ALL kids have the right to a public education-disabled or not.
